These end-user terms govern how authenticated users interact with the Pearl Education Products (the web app and the mobile app). They apply to “Authorized Users” — administrators, instructors/tutors, program staff, and, where the School configures access, students and parents/guardians (MSA §1.2).

Relationship To The Customer Agreement

The binding commercial contract is the Master Service Agreement (MSA) and Order Form signed by the customer (the School or agency). These end-user terms supplement that contract and do not replace it; if there is a conflict, the signed MSA and its exhibits control (MSA §18.7). End users do not sign the MSA — the customer accepts it on their behalf.

Your Right To Use The Products

Authorized Users receive a non-exclusive, non-transferable right to access the Products in accordance with Pearl’s Documentation, for the School’s internal operations and educational programs (MSA §2.1).

Accounts

• Accounts are for named individuals and may not be shared (MSA §3.1).
• Keep your credentials secure. Report any unauthorized access promptly to seccom@poweredbypearl.com (MSA §3.1).

Acceptable Use

Authorized Users must not (MSA §3.3):

• sell, sublicense, distribute, or provide third-party access to the Products except as authorized;
• reverse engineer or copy the Products, or build competing products using them;
• circumvent security or access controls, probe or scan Pearl systems, or introduce malicious code;
• access the Products other than through supported interfaces;
• use the Products to store or transmit unlawful, infringing, or harmful material, or unsolicited communications; or
• remove proprietary notices.

Messaging And Communications

In-product messaging is Product functionality for support and for authorized user-to-user communication (for example, student↔instructor). Use it only for authorized, education-related purposes — not for unsolicited or harmful communications (MSA §3.3).

Students And Parents

For student users, the School uses commercially reasonable efforts to enforce these rules and cooperates with Pearl to investigate and remediate violations (MSA §3.3). Decisions about student data, including consent, sit with the School, not Pearl. Pearl acts as a FERPA school official / service provider on the School’s behalf. Enforcement

Misuse may lead to suspension or termination consistent with the customer’s agreement (MSA §10.2). Pearl and the School cooperate to investigate and address violations.
